These Terms and Conditions ("Terms") govern all contracts, quotations, construction works, and related services provided by SteelKeelHouse Canada iNC. ("Company", "we", "us", "our"), a steel keel house construction company. By engaging our services, the client ("Client", "you") agrees to be bound by these Terms.

1. Scope of Work

1.1 The Company provides services including, but not limited to: steel keel (light gauge steel) house design, manufacturing, supply, installation, construction, renovation, and related consulting services.

1.2 The scope of work shall be strictly limited to what is specified in the signed quotation, proposal, or contract documents.

1.3 Any work not expressly stated in the agreement shall be considered additional work and may incur extra charges.

2. Quotations and Pricing

2.1 All quotations are valid for 30 days unless otherwise stated.

2.2 Prices are based on current material, labor, transportation, and regulatory costs. Any increase beyond our control may result in price adjustments.

2.3 Quoted prices exclude taxes, permits, inspection fees, utility connection fees, and government charges unless explicitly stated.

3. Payment Terms

3.1 Payment shall be made according to the payment schedule outlined in the contract or invoice.

3.2 Typical payment structure may include:

  • Deposit upon contract signing

  • Progress payments at agreed milestones

  • Final balance upon project completion

3.3 Late payments may result in work suspension and may incur interest at 5% per month or the maximum allowed by law.

3.4 All payments are non-refundable once work has commenced, except where required by law.

4. Project Timeline

4.1 Project timelines are estimates only and may be affected by weather, site conditions, material availability, labor issues, government approvals, or force majeure events.

4.2 The Company shall not be held liable for delays beyond its reasonable control.

5. Client Responsibilities

5.1 The Client shall:

  • Provide accurate site information and legal access to the property

  • Obtain necessary permits unless otherwise agreed

  • Ensure site readiness (level ground, utilities, access roads)

  • Make timely payments

5.2 Delays caused by the Client may result in additional costs and timeline extensions.

6. Design Changes and Variations

6.1 Any changes requested after approval must be submitted in writing.

6.2 Variations may result in additional costs and timeline adjustments.

6.3 The Company is not responsible for errors arising from Client-approved designs.

7. Materials and Specifications

7.1 Steel keel materials shall conform to industry standards unless otherwise specified.

7.2 Material substitutions of equal or higher quality may be made if original materials become unavailable.

7.3 Minor variations in color, texture, or finish are considered acceptable.

8. Warranties

8.1 The Company warrants that construction will be performed in a professional manner consistent with industry standards.

8.2 Structural steel keel components are warranted for 1 year, subject to proper use and maintenance.

8.3 Warranties do not cover damage caused by:

  • Natural disasters

  • Improper use or maintenance

  • Unauthorized modifications

  • Normal wear and tear

9. Inspections and Acceptance

9.1 The Client shall inspect the work upon completion.

9.2 Any defects must be reported in writing within 60 days of completion.

9.3 Failure to report issues within this period constitutes acceptance of the work.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages.

10.2 The Company’s total liability shall not exceed the total contract value.

11. Termination

11.1 Either party may terminate the contract for material breach with written notice.

11.2 Upon termination, the Client shall pay for all work completed and materials ordered up to the termination date.

12. Force Majeure

The Company shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, war, strikes, pandemics, or government actions.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of ON CANADA.

14. Dispute Resolution

Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall be subject to mediation or arbitration before court proceedings, where permitted by law.

15. Entire Agreement

These Terms, together with the signed contract or quotation, constitute the entire agreement between the parties and supersede all prior discussions or agreements.

16. Amendments

The Company reserves the right to update these Terms at any time. Updated Terms shall apply to new contracts only.
